Welcome to DramaKing. These Terms of Service ("Terms") form a binding agreement between you and Launcher Capital Inc., a corporation organized under the laws of the State of Delaware, USA, which operates DramaKing (the "Company," "we," "us," or "our"). They govern your access to and use of the DramaKing website, applications, and related services (collectively, the "Services"). Please read them carefully.
1. Acceptance of Terms
By accessing or using the Services, creating an account, or purchasing or using virtual coins, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, you may not use the Services.
2. Eligibility
The Services are intended only for adults aged 18 years or older. By using the Services, you represent and warrant that you are at least 18 years of age and that you have the legal capacity to enter into these Terms. The Services are intended for users located in the United States. If you do not meet these requirements, you may not use the Services.
3. Accounts
You access the Services by signing in with Google ("Google Sign-In"). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your account.
4. Virtual Coins and Credits
The Services use a virtual currency ("Coins") that lets you unlock episodes and access certain content. Some content is free; other content requires Coins. By purchasing or using Coins, you acknowledge and agree that:
- No monetary value. Coins have no real-world monetary value. They are not money, currency, or any form of property, and they cannot be redeemed for cash or any monetary equivalent.
- Limited license, not property. Coins represent a limited, personal, revocable, non-transferable, non-sublicensable license to access digital content within the Services. You do not own Coins, and they may not be sold, traded, gifted, or transferred outside the Services.
- Non-refundable. All purchases of Coins are final and non-refundable, except where a refund is required by applicable law.
- Expiration. Coins may expire and may be forfeited, including upon account closure or termination, or after a period of inactivity, as permitted by law.
- Changes. We may, at any time and at our discretion, modify the pricing, packaging, availability, or features of Coins, and we may introduce, limit, or discontinue Coins or content. Such changes do not entitle you to a refund.
Coin purchases are processed by our third-party payment processor (Stripe). You agree to pay all applicable charges and taxes associated with your purchases.
5. License to Use the Services and Content
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and stream content through the Services for your own personal, non-commercial viewing only.
You may not, and may not permit others to: download, copy, record, reproduce, distribute, publicly perform, publicly display, broadcast, sell, rent, sublicense, modify, or create derivative works from any content; circumvent, disable, or interfere with any access controls, digital rights management, or security features; or use any automated means to access, scrape, or harvest content. All rights not expressly granted are reserved.
6. Acceptable Use
When using the Services, you agree not to:
- violate any applicable law or regulation, or infringe the rights of others;
- access content you have not properly unlocked, or attempt to bypass payment or Coin requirements;
- reverse engineer, decompile, or disassemble any part of the Services;
- introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Services or related systems;
- interfere with, disrupt, or place an undue burden on the Services or their infrastructure;
- use bots, scrapers, or other automated tools to interact with the Services;
- block, hide, or interfere with the display of advertising; or
- use the Services for any commercial purpose or in any manner that is fraudulent, deceptive, or harmful.
We may investigate and take appropriate action, including suspending or terminating accounts, for any violation of these Terms.
7. Advertising
The Services are supported in part by advertising. By using the Services, you acknowledge and agree that we and our advertising partners (which may include Google AdSense / Google Ad Manager and Aniview) may display advertisements within the Services. We are not responsible for the content of third-party advertisements or for any products, services, or websites they promote. You interact with advertisers at your own risk.
8. Intellectual Property
The Services and all content made available through them — including videos, episodes, series, text, graphics, logos, trademarks, software, and design — are owned by the Company or our licensors and are protected by copyright, trademark, and other intellectual property laws. The DramaKing name and logo are our trademarks and may not be used without our prior written permission. Except for the limited license expressly granted in these Terms, nothing here transfers to you any right, title, or interest in the Services or any content.
9. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, that content will always be available, or that defects will be corrected. The Services are an early-stage, experimental offering and may change, be unavailable, or be discontinued at any time.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE NINETY (90) DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Termination
We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including if we believe you have violated these Terms, with or without notice. You may stop using the Services at any time. Upon termination, your right to use the Services and any unused Coins will cease, and we will have no obligation to provide a refund except where required by law. Sections that by their nature should survive termination — including those on virtual Coins, intellectual property, disclaimers, limitation of liability, and governing law — will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.
13. Governing Law
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any dispute not subject to other agreed dispute-resolution procedures.
